To achieve these goals, the Act employs various mechanisms designed to protect both individual species and the broader ecosystems upon which they depend.

The legislative framework is supported by several key provisions that dictate how conservation efforts are managed:

  • Section 4: Requires the agencies overseeing the ESA to officially designate imperiled species as either “threatened” or “endangered.”
  • Section 9: Prohibits the unlawful “take” of such species, which encompasses actions including harassing, harming, or hunting.
  • Section 7: Mandates that federal agencies utilize their existing authorities to assist in the conservation of listed species.

In addition to domestic protections, the ESA serves as the enacting legislation for the provisions outlined in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The administration of the Act is divided between two primary federal agencies: the United States Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS). These agencies are granted the authority to establish rules and guidelines within the Code of Federal Regulations to implement the law’s provisions effectively.
